Judge Grants Approval to Monumental Environmental Settlement in Deepwater Horizon Claims

On Monday, April 4, 2016, after months of public review and comment as well as Court scrutiny, Judge Carl J. Barbier, who oversees MDL 2179, entered the consent decree settling the Natural Resource Damage (“NRD”) claims of Louisiana, the Federal Government and other Gulf States impacted by the Deepwater Horizon Oil Spill as well as claims under the federal Clean Water Act (“CWA”). The NRD and CWA settlement was the largest in the history with Louisiana recovering the greatest share due to the severity of the oil spill’s impact on the State. Kanner & Whiteley, represented the State of Louisiana in the prosecution of its claims against BP and participated in the settlement of the State’s NRD as well as economic loss claims, that were settled separately. The firm is pleased that the State can now turn towards the restoration and protection of its valuable coastal resources and environment and the welfare of its citizens after the devastation resulting from the 2010 spill.
