On September 22, 2025, a Pennsylvania federal court denied shampoo manufacturer’s motion to dismiss a plaintiff’s claims alleging manufacturer is liable for damages resulting from purchases of its coal tar shampoo which is alleged to contain benzene, including breach of express warranty, breach of implied warranty, consumer protection and negligence. The Court also found that plaintiff’s claims for failure to comply with good manufacturing practices (cGMPs) are not preempted under federal law and that at this point the plaintiff has standing to proceed on her on behalf as well standing to maintain multi-state claims in the matter.
