Allan Kanner was quoted this week in Law360’s article, “J&J May get Lifeline in Talc Trials from Mo. High Court,” discussing the fairness of allowing multiple plaintiffs to go to trial together. Johnson & Johnson is challenging this common practice in front of the Missouri Supreme Court by arguing that it is unfair to try cases with more than one plaintiff at a time. Mr. Kanner doesn’t think there should be a hard and fast rule against combining plaintiffs. He noted that multi-plaintiff trials have been done successfully for years and any possible unfairness could be cured with simple jury instruction.
