Judge refuses Shell’s attempt to halt discovery; Case will move forward.

Court rejects Shell defendants’ request for a stay while the Connecticut Department of Energy and Environmental Protection finalizes a pending draft of a General Permit for the Discharge of Stormwater Associated with Industrial Activity, finding defendants did not establish either prejudice absent a stay or any sort of substantial or overwhelming likelihood of success that the new permit will resolve the vast majority of disputes in the case. The action will proceed through the normal process of discovery and summary judgment. The Court also rejected the defendants’ motion to strike certain expert opinions as procedurally improper, concluding that the issues raised are well known to the court and do not require the urgent treatment requested but should be brought in the normal course of the proceedings.  3:21-cv-00933-VDO, USDC, D.
