On June 29, 2015, the Court found in favor of the State of Louisiana, allowing the State’s claim of fraud to proceed against Defendants Takeda Pharmaceuticals and Eli Lilly. The State has alleged that Defendants’ false and misleading marketing and promotional efforts misled Louisiana healthcare professionals, consumers, and the State into believing that Actos was a safe and effective diabetes. The truth, however, was that the drug posed a serious risk of bladder cancer.
