Kanner & Whiteley, as Counsel for the State of New Mexico, files Motion for Partial Summary Judgment under CERCLA for PFAS Liability at New Mexico Air Force Base

On Wednesday, June 25, 2025, Kanner & Whiteley, as Counsel for the State of New Mexico, the New Mexico Environment Department, and the New Mexico Natural Resources Trustee, filed a Motion for Partial Summary Judgment against the United States and Air Force to establish CERCLA liability for widespread PFAS contamination at Cannon Air Force Base in New Mexico, and in the surrounding area. In particular, PFAS released into the environment at Cannon have severely contaminated the underlying Ogallala aquifer—a precious and declining groundwater resource upon which both residents and Cannon rely. The Motion seeks to establish the United States and Air Force’s liability for costs incurred by the State in responding to the contamination, and for damages to natural resource.
