Kanner & Whiteley, along with its co-counsel, have filed a class action lawsuit against Amalie Oil for its marketing and sale of obsolete motor oil in Florida. Amalie Oil sells motor oil under its XCEL Premium label that is obsolete and harmful for use in modern automobiles. The motor oil is rated SA, meaning it is not suitable for use in automotive engines manufactured after 1930. The lawsuit is brought on behalf of persons in Florida who have a post-1930 automobile and who purchased Amalie Oil’s XCEL Premium motor oil for use in their automobile. The suit brings claims for violations of Florida’s Deceptive and Unfair Trade Practices Act, violations of Florida’s Misleading Advertising Law, and unjust enrichment.
