On Tuesday, October 1, New Orleans law firm Kanner & Whiteley, L.L.C. secured a $42.5 million settlement on behalf of Attorney General James “Buddy” Caldwell to resolve the State’s claims in State of Louisiana v. GlaxoSmithKline, LLC (GSK) involving the promotion and marketing of the oral anti-diabetic drug Avandia®.
After two and a half years of litigation, GSK’s agreement to pay the State of Louisiana $42.5 million is the highest state settlement of its kind in the pharmaceutical litigation context. The $42.5 million Avandia® settlement represents the largest of the eight state settlements with over five times the $8.6 million amount Louisiana Medicaid reimbursed for Avandia® prescriptions between 1999 to present.
