On August 10, 2026, the New Jersey Superior Court in Middlesex County approved NJDEP’s settlement with Hercules LLC, which resolves Hercules’ liability to NJDEP for alleged natural resource injuries to groundwater, soil, sediment, surface water, and biota at four Hercules Sites, with the exception of natural resources impacted in the Delaware River by discharges at the Hercules Gibbstown Site. Through the settlement, NJDEP will receive $4.5 million and three significant conservation easements covering over 600 acres of wetlands and uplands in New Jersey to preserve and protect natural resources in perpetuity.
