On August 20, 2026, the New Jersey Superior Court in Middlesex County approved NJDEP’s settlement with Hess Corp., in which Hess Corp. agreed to pay NJDEP $19.5M to resolve its liability to NJDEP for alleged injuries to natural resources resulting from discharges at and from the former Hess Refinery. The settlement does not resolve, and specifically excludes, NJDEP’s natural resource damage claims associated with offsite surface waters and sediments, such as the Arthur Kill and Smith Creek.
